Special Notices

This Poca User Agreement (the "Agreement") governs your use of Poca's services (the "Services"), including the Poca App, a social content platform operated by PT. BRIGHT PIXEL LABS, Limited ("we," "us," or "Poca"), with its registered address at Ruko Campton Blok B No. 11 Kel. Sampora, Kec. Cisauk Kabupaten Tangerang Banten 15345 Indonesia. By accessing or using the Services, clicking "Sign Up," or continuing to use the Services after modifications to this Agreement, you agree to be bound by all terms herein, our Privacy Policy, and any supplementary guidelines published on the platform.

When using the Poca Services, you will be subject to Poca Privacy Policy and you be subject to additional guidelines or rules that are posted on the Poca Services or made available to you, or applicable to specific services and features that are disclosed to you in connection with such services.

By using our Services, or by clicking on "Sign Up" during the registration process, you agree to all terms of this Agreement. We, at our sole discretion, may revise this Agreement from time to time, and the current version will be found at the following link: About us>User Agreement.

You may only use our Service if you are 18 years or older, and if you are not subject to statutory age limit to enter into this Agreement according to the applicable laws and regulations in your country.

We do not accept payments or do business with individuals or entities in Cuba, Iran, North Korea, Sudan, Syria, and the Crimean region. If you are from such regions, you may be prohibited from using the Poca Services.

Services Content

i. User Generated Content

Poca allows users to distribute streaming live, use services, such as chat, bulletin boards, forum postings, voice interactive services, and to participate in other activities in which you may create, post, transmit, perform, or store content, messages, text, sound, images, applications, code or other data or materials on the Services ("User Content"). Users of the Poca Services may also overlay music, graphics, stickers, virtual items and other features provided by Poca ("Poca Features") onto this User Content and transmit this User Content through the Poca Services.

ii. Help you discover content, products, and services

We show you ads, offers, and other sponsored content to help you discover content, products, and services that are offered by the many businesses and organizations that use Poca.

iii. Combat harmful conduct and protect our community

We employ dedicated teams around the world and develop advanced technical systems to detect misuse of our Poca Services, harmful conduct towards others, and situations where we may be able to help support or protect our community.

iv. Global access to our Services

To operate our global service, we need to store and distribute content and data in our data centers and systems around the world, including outside your country of residence.

Account

In order to open an account, you will be asked to provide us with certain information such as an account name and password.

You are solely responsible for maintaining the confidentiality of your account and password, for restricting access to your computer, and for all activities that occur under your account or password. Please make sure the information you provide to Poca upon registration and at all other times is true, accurate, current, and complete to the best of your knowledge.

We reserve the right to disable your user account at any time, including if you have failed to comply with any of the provisions of these terms, or if activities occur on your account which, in our sole discretion, would or might cause damage to or impair the Poca Services.

If you no longer want to use our Services again, and would like your account deleted, we can take care of this for you. Please contact us via info@Poca.chat, and we will provide you with further assistance and guide you through the process.

Privacy

Your privacy is important to Poca. Please see our Privacy Policy for information relating to how we collect, use, and disclose your personal information, and how you can manage your online privacy when you use the Poca Services.

Use of the Services

Your access to and use of the Poca Services is subject to these terms and all applicable laws and regulations. You agree that you will comply with these terms of Poca Services and Poca's Community Guidelines and will not:

  • create, upload, transmit, distribute, or store any content that is inaccurate, unlawful, infringing, defamatory, obscene, pornographic, invasive of privacy or publicity rights, harassing, threatening, abusive, inflammatory, or otherwise objectionable;
  • impersonate any person or entity, falsely claim an affiliation with any person or entity, or access Poca accounts of others without permission;
  • defame, harass, abuse, threaten or defraud users of Poca, or collect, or attempt to collect, personal information about users or third parties without their consent;
  • remove, circumvent, disable, damage or otherwise interfere with security-related features of the Poca Services;
  • reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Poca Services;
  • modify, adapt, translate or create derivative works based upon the Poca Services;
  • interfere with or damage operation of the Poca Services or any user's enjoyment of them;
  • manipulate identifiers in order to disguise the origin of any User Content transmitted through the Poca Services;
  • interfere with or disrupt the Poca Services or servers or networks connected to the Poca Services;
  • attempt to circumvent any content filtering techniques we employ;
  • use the Poca Services for any illegal purpose, or in violation of any local, state, national, or international law or regulation.

Virtual Items

You can only buy virtual tokens ("Tokens") and virtual gifts (Gifts), send Gifts to others, receive Gifts with monetary value, earn virtual credits ("Credits") and withdraw Credits if you are aged 18 (or age of majority in your jurisdiction) or older.

The price of the Tokens will be displayed at the point of purchase. All charges and payments for Tokens will be made in the currency specified at the point of purchase through the relevant payment mechanism.

Except as otherwise set out in this Agreement, all sales of Tokens and Gifts are final, and we do not offer refunds for any purchased Tokens and Gifts. Tokens and Gifts cannot be converted into or exchanged for cash.

User-Generated Content

Users may create, post, transmit, perform, or store content, messages, text, sound, images, applications, code, or other data or materials on the Poca Services ("User Generated Content/UGC"). We also permit users to distribute pre-recorded audio-visual works and to use Poca Services, such as chat, bulletin boards, forum postings, and voice interactive services.

If you publish, post, display, submit, and/or upload any of your user-generated content (UGC) in connection with the Poca Services, you grant Poca and its sub-licensees the freedom to use, copy, modify, adapt, publish, translate, edit, dispose of, create derivative works of, distribute, perform, and publicly display such UGC.

Content Moderation Guidelines

You explicitly understand and agree not to engage in the creation, dissemination, or promotion of content that falls within the following categories:

  • Unlawful Conduct: Any content that encourages, promotes, or facilitates activities that are illegal
  • Discriminatory Practices: Any content that directly or indirectly attacks, discriminates, or targets a person or group
  • Threats and Harassment: Any content intended to intimidate, threat, harass, or that propagates violence
  • Child Sexual Abuse Content (CSAM): We have zero tolerance for CSAM
  • Violent or Dangerous Threats: Any content that conveys threats of violence or harm
  • Intellectual Property Violations: Any content that infringes upon intellectual property rights
  • Misinformation and Disinformation: Any content that spreads verified false or misleading information
  • Spam and Malicious Conduct: Any unsolicited commercial messages or attempts at phishing
  • Self-Harm and Suicide Promotion: Any content that contributes to the glorification or encouragement of self-harm

Third-Party Content

Poca Service may offer additional third-party material on the Poca Services. It should be noted that Poca has no control over, affiliation with, or warranty of any kind regarding any Third-Party Content. The choice of whether or not to use or access third-party websites or applications is yours.

Payment Terms

We accept major credit cards, certain debit cards and/or such other payment methods we may make available to you from time-to-time through our site, as forms of payment.

If you purchase an auto-recurring periodic subscription through an in-app purchase, your Payment Method will continue to be billed for the subscription until you cancel. You may unconditionally withdraw your consent to automatic card payments at any time.

Intellectual Property Rights

All text, data, images, graphics, audio and/or video information and other materials within the Poca Services provided by Poca are property of Poca are protected by copyright, trademark and/or other property rights laws. Nothing in this Agreement shall be construed as conferring any license of any intellectual property rights.

Terminating Services

To the fullest extent permitted by applicable law, Poca reserves the right, without notice and in our sole discretion, to terminate your license to use the Poca Services, and to block or prevent your future access to and use of the Poca Services.

Disclaimers

You shall be fully responsible for any risks involved in using Poca Services. Any use or reliance on Poca Services will be at your own risk.

Under no circumstance does Poca guarantee that the Services will satisfy your requirements, or guarantee that the Poca Services will be uninterrupted. The timeliness, security and accuracy of the Poca Services are also not guaranteed.

Legal Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Singapore International Arbitration Centre, without regard to choice of law principles. Any dispute arising out of or in connection with this Agreement shall be referred to and finally resolved by arbitration.

Modification of the Agreement

We amend these terms of the Agreement from time to time, for instance when we update the functionality of our Services. We will use commercially reasonable efforts to generally notify all users of any material changes to these terms. Your continued access or use of the Poca Services after the date of the new terms constitutes your acceptance of the new terms.

Other Terms

This Agreement constitutes the entire agreement of agreed items and other relevant matters between both parties. Other than as stipulated by this Agreement, no other rights are vested in either Party to this Agreement.

If any provision of this Agreement is rendered void or unenforceable by competent authorities, in whole or in part, for any reason, the remaining provisions of this Agreement shall remain valid and binding.
